    USPTO Proposes New Measure to Improve Patent Quality and Reduce Pendency.

   The Department of Commerce’s United States Patent and Trademark Office (USPTO) is proposing new rules in the Federal Register that will improve an examiner’s ability to focus the examination process for claims that contain more than one independent and distinct invention.  

   “We believe such a rule change will lead to a more focused examination process that will effectively promote innovation,” noted Commissioner for Patents John Doll.  

   The proposed rules focus on the current practice of listing multiple inventions in the alternative in a single claim.  Such “multi-invention alternative” claims are especially prevalent in the pharmaceutical, chemical, and biotechnology fields.  The USPTO is proposing rules that would require applicants to identify, with more specificity, the claimed invention to be examined, thus promoting examination quality.  

   These proposed rules are in addition to the final rules pertaining to claims and continuations, which are expected to be published in the Federal Register later this month and are part of the USPTO’s ongoing effort to ensure patent quality, foster the examination process, and reduce pendency.   

   The USPTO welcomes comments on the proposed rules, as well as further suggestions for changes that would improve the examination of such claims.  To be considered, written comments must be received on or before October 9, 2007.  No public hearing will be held.

   The proposed rules are available in the Federal Register today.

Global patent applications grow by 4.7% annually
Worldwide patent applications are growing at an average rate of 4.7% per year, according to the 2007 edition of the World Intellectual Property Organization (WIPO)\'s Patent Report.
\"We have witnessed a significant increase in the use of the patent system internationally in recent years,\" says WIPO Director General Dr Kamil Idris. \"This is clearly one indicator of the level of inventiveness and innovation that is occurring around the world and signals those areas in which technological development is most pronounced.\"
WIPO\'s report, which was published on the website this week, looks at 2005 figures, the last year for which complete worldwide statistics are available.
It shows that the number of patents granted has increased at an average annual rate of 3.6%, with 600 000 patents granted in 2005. At the end of 2005, around 5.6 million patents were in force around the globe.
Emerging economies
The Republic of Korea and China recorded the highest growth in application numbers and the northeast Asian region continues to increase its share of worldwide patenting. Between 1995 and 2005, patent filings by residents doubled in Korea and increased eight fold in China.

Patent Information - Benefit or Burden?

Many studies have shown that, in Europe at least, the majority of small and medium sized industries, have either no awareness of patent information, or think it is too troublesome to retrieve - too much overhead for too little gain.

But what kind of incentive could persuade these SMEs that patent information is a valuable resource for innovation and competitiveness, and that patent information is easily accessible - via esp@cenet for instance?

We think simply that money might work!

We are actively promoting patent information as a resource for FP7 participants so that they can make better proposals to the EU and increase their chances of getting FP7 funding for their projects.

专利信息-获利还是负担?

Qualcomm\'s ongoing feud with Nokia intensified Friday as the Finnish cell phone maker filed patent infringement claims with the U.S. International Trade Commission.

Claims and Continuations Final Rules to Publish in Late Summer
On July 9, 2007, OMB concluded its review of the Continuations and Claims rule changes. The final rules will be made public when they are published in the Federal Register, which is expected to be later this summer. The rules will become effective at least 60 days after publication in the Federal Register, and no earlier than October 1, 2007.

World Intellectual Property Day 2006
April 2006

Six years ago, WIPO Member States decided to designate a World Intellectual Property Day. Their aim was to raise awareness of the role of intellectual property in daily life, and to celebrate the contribution made by innovators and artists to the development of societies across the globe. They chose April 26, the date on which the Convention establishing WIPO entered into force in 1970.
The response has grown more enthusiastic every year, with ever more government ministries, NGOs, industry groups, and educational institutions joining the celebrations with new activities and events. This year the theme proposed by WIPO focuses on ideas, as the starting point of all intellectual property. WIPO has dispatched posters and promotional materials to IP offices and organizations around the world; and a 30-second spot promoting World Intellectual Property Day will be broadcast on international television channels.
The next edition of the Magazine will include a round up of reports from Member States on this year’s events.
