Sony Faces Patent Suit Over PlayStation 3
Portfolio Media, New York (July 30, 2007)--Sony Corp. of America has been hit with a lawsuit alleging its PlayStation 3 infringes a patent covering the partitioning of a computer program into smaller concurrent processes, and seeking an order for the “impounding and destruction” of all Sony products found to encroach on the patent.
Newport Beach, Calif.-based Parallel Processing Corp. filed the lawsuit in the U.S. District Court for the Eastern District of Texas on Thursday.
At issue is U.S. Patent Number 5,056,000, entitled “Synchronized parallel processing with shared memory” and issued in October 1991.
Sole defendant Sony Corp. of America has and continues to infringe the \'000 patent by making and selling products including, but not limited to, Sony PlayStation 3, according to Parallel Processing\'s complaint.
The complaint also accuses Sony of contributory infringement, as well as of inducing others to infringe the patent in suit, and says that unless the court steps in, the alleged infringement will keep going on and cause the plaintiff irreparable harm and monetary damage.
Sony is aware of the \'000 patent, which is valid and enforceable, and is willfully infringing it, Parallel Processing further contends.
Parallel Processing\'s suit asks the court to enjoin Sony from continuing its alleged infringement, award the plaintiff treble damages and attorneys\' fees, and to “order the impounding and destruction of all defendant\'s products that infringe the \'000 patent.”
The \'000 patent relates to a parallel processing computer system using synchronous phases. Parallel processing is the ability to break up a single, large computer program into pieces that can be dealt with simultaneously in different processors, thus maximizing output, according to the \'000 patent\'s description on the U.S. Patent and Trademark Office\'s Web site.
In March 2006, chip maker Agere Systems Inc. sued Sony Corp. in the same Texas court, accusing Sony of infringing eight patents through several Sony products including computers and wireless LAN cards, and warning that, based on “announced specifications,” PlayStation 3 would infringe three of the patents at issue when launched.
New York City-based Sony Corp. of America is a subsidiary of Tokyo\'s Sony Corp. Sony employs 163,000 people around the globe, and had about $70.3 billion in consolidated annual sales for the fiscal year ending on March 31, 2007, of which $18.9 billion came from U.S. sales, according to Sony Corp. of America\'s Web site.
A Sony spokesperson was not immediately available to comment on the lawsuit.
Parallel Processing Corp. is represented in its suit against Sony by the Albritton Law Firm, the Ward & Smith Law Firm and Simon Passanante PC.
The case is Parallel Processing Corp v. Sony Corp. of America, case number 07-353, in the U.S. District Court for the Eastern District of Texas.
