在进行专利分析的时候,我就看到如此:
claim1: 1. A fastener assembly for use in joining first and second structural elements to be joined, comprising:

且其中锚装置的凸出部件20是具刚性的,如此,即使大大地增加拉力应力,也可防止锚装置的末端33从和第一结构元件的初始位置处运动。

如上只为us5,944,466的前两项独立权利要求,还有众多的独立权利要求,对此我非常困惑,虽然权利要求书的撰写是有不断的重复,
在侵权比对的时候,我一般只将第一个独立权利要求拿出来作全要件比对,如果不存在争议,便在此终止,不再考虑其余独立项的内容
我的这种做法不知道对不对?

首先,本人没有做过侵权这块,都是自己的意见,仅供参考。
注意:一件申请有多个独立权利要求,就表明有多个要求得到保护的对象(发明或实用新型)。在批准获得权利过程中也同样是逐一审查,包括附属权利要求。若仅对一件申请的一个独立权利要求进行比对显然不够。
至于LZ所说的撰写上重复,首先每个独立权利要求绝对不会重复(相同),而附属的可能会有重复,但是附属对象又有不同,应当分别对应看待。
当然,同一申请由于单一性的要求,各个独立权利要求都是相关联的,有的改动确实不大,只是基于另外实施例的不同总结,但是确有不同,且权利不同,建议还是要注意。

我没仔细阅读楼主提供的内容,但每个独立权利要求之间肯定是有技术区别特征的。因为同一件申请中的多个独立权利要求必须要符合单一性,所以每个独立权利要求中应该有相同或相应的技术特征,然后再包括各自的特征技术,对于相同的技术特征部分的描述肯定是相同的,有时候读起来,确有重复的感觉,但由于他们存在区别特征,就是不同的技术方案,对比时,当然都要考虑。

我觉得:专利的对比,应该将参考对象先逐一和每一个独立权利要求进行比较,如果独立权利要求不存在争议,可以不考虑其从属权利要求,如果存在争议,再和所述独立权利要求的从属权利要求相比较。

一件申请多个独立权利要求是为了省费用

有多个独立权利要求这说明关于这个发明有多个技术方案,而这些技术方案之间又有许多相同之处,放在同一个案件中申请,主要是为了经济的原因,因为这样作可以省去多次申请而花费的费用,和侵权没多大关系,这只是我的观点,请大家指教。

楼主仅仅对比权利要求1的做法显然是不正确的
楼主所列专利文件中,虽然有多个独立权利要求,且多个独立权利要求之间有很多重复的技术特征(以符合单一性),但也必然存在不同的技术特征,因此,如果楼主对比侵权要件时,如果只对比第一项独立权利要求,发现未侵权便终止对比的话,很可能会有侵犯其它项权利要求专利性的风险。不过鄙人以为,如果楼主想偷懒的话,对比了独立权利要求,发现不侵权的话,那么就不用再对比引用该独立权利要求的从属权利要求了。
