急！ 美国专利实务 extension of time fee的问题

答复日为2009.3.18
2009.6.29发来一个通知交延长时间费的通知，上面写last date that extension may be obtained:2009.4.20 (最多延长5个月)

问题是现在已经超过4月20号了呀，延长时间的起点是哪天啊？现在算第几个月？

If an applicant is required to reply within a nonstatutory or shortened statutory time period, applicant may extend the time period for reply up to the earlier of the expiration of any maximum period set by statute or five months after the time period set for reply.

The date on which the petition and the fee have been filed is the date for purposes of determining the period of extension and the corresponding amount of the fee. The expiration of the time period is determined by the amount of the fee paid.

试试看，回答不一定完全正确，仅供参考。

1. 通知发出日为2008.9.19 期限两个月，则2008.11.19为答复期限，不需缴费。
2. 答复日为2009.3.18，即超过了答复期限4个月，需交4个月的费，即1730USD（865USD small entity）.
3. 不明白为什么是最多延长5个月，因为法律规定最长不能超过6个月，前面已经有两个月的期限，也就是最多只能再延长4个月。
4. 跟现在的日期无关，因为答复已经交了，只要补交4个月的延长时间费即可。但要注意这张通知是不是也有一个答复期限，超过期限不答复也会有问题的。

这两段英文里包含的内容：

1. 通知上的期限2个月是审查员定的期限，比法定的期限短，因而是a nonstatutory or shortened statutory time period。

2. applicant may extend the time period for reply up to the earlier of the expiration of any maximum period set by statute or five months after the time period set for reply. 申请人可以获得的延时是下面两个之中早的那一个：（1）法律规定的最长期限，通常OA的回复是6个月（也有特殊情况不是6个月的）；（2）设定的答复期限加上5个月。

3. 延长的日期和相应的延时费的计算取决于送交答复和延时请求的日期。交付费用的数目决定了延长时间的长短。也就是说如果交了一个月的延时费但答复是在延时2个月以后交的，则还得补交相应的延时费。

这个不是OA，要求交missing part，法定期限应该不是6个月。

“延长的日期和相应的延时费的计算取决于送交答复和延时请求的日期”这句话让我很费解，是说完成答复和付费这两项要求的那天决定了要延长多少时间吗？虽然答复是在2009.3.18完成的，可是还没交延时费也没有交延时请求，而你说“跟现在的日期无关，因为答复已经交了，只要补交4个月的延长时间费即可”感觉很矛盾。

简单地说，你在4个到期之前交了答复，你应该交4个月的钱，但只交了0个月的钱，所以你还欠他们4个月的钱。

“延长的日期和相应的延时费的计算取决于送交答复和延时请求的日期”这里面实际上只有送交答复的日期，因为美国不要求递交单独的延时请求，规定期限到实际答复的日期就是实际延长的时间。

OA（审查意见通知书）答复期限: 3+3=6个月（交1、２或３个月的延期费）
Missing Parts Notice（相当于我们的补正通知书）答复期限: 2+5=7个月（交１、２、３、４或５个月的延期费）。
