“SMALL ENTITY” for purposes of patent and design patent applications means an independent inventor; or a small business, which is defined as a business whose number of employees, including employees of affiliated organizations (directly or indirectly controlling or controlled by), on the average during a fiscal hear does not exceed 500 persons; or non-profit organizations which include institutions of higher education and organizations which do, or would so qualify under U. S. tax laws. Half fees are applicable only if the invention has not ben licensed or contracted to be licensed to an organization which itself does not qualify for half fees.
A statement by the claimant supporting status as a small entity must be filed in the U.S. Patent Office at the time status as a small entity is claimed. Until such statement is filed, applicant is not considered to be a small entity and must pay the full, higher fees. If there is any doubt, the higher fees should be paid. |
